The petitioner, who is husband of the deceased, seeks bail in anticipation of his arrest in connection with Hathauri P.S. Case No. 191 of 2019 dated 13.09.2019 instituted for the offences under Sections 304(B) and 34 of the Indian Penal Code.

After some arguments, Mr. Devendra Kumar, learned counsel for the petitioner seeks permission to withdraw this application in order to enable the petitioner to surrender before the Court below and seek bail.

Should the petitioner surrender before the Court below, the grounds noted in the bail application shall be taken into account and an order shall be passed without being
