2. The petitioner apprehends his arrest in connection with Siwan Town P.S. Case No. 767 of 2024, registered for the offences under Section 126(2), 115(2), 118, 329(3), 106 & 3(5) of BNS, 2023 and subsequently Section 106 was removed and Section 109 of BNS, 2023 was added on vide order dated 19.12.2024.
3. The prosecution story, in brief, is that on 05.12.2024 at 7:30 PM, when informant's son went to Darbar compound, Siwan to change the cover and screen guard of his phone, he was surrounded by the petitioner and co-accused persons. Thereafter Co-accused Faizal Khan attacked on the informant's son with a knife which caused serious injury to him.
Patna High Court CR. MISC. No.51989 of 2026(2) dt.29-07-2026 2/3 It is further alleged that the fight happened due to old dispute and due to injuries, the informant's son was admitted in Medanta Hospital, Patna for better treatment.
4. The learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The counsel further submits that the petitioner has no criminal antecedent and the allegation against him is general and omnibus in nature.
5. Learned APP for the State vehemently opposes the prayer for bail of the petitioner.
6. Having heard the parties, I am of the considered view that since there is no specific allegation against the petitioner, I am inclined to grant the petitioner benefit of anticipatory bail. Let the above named petitioner, in the event of arrest/surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Siwan Town P.S. Case No. 767 of 2024, registered for the offences under Section 126(2), 115(2), 118, 329(3), 106 & 3(5) of BNS, 2023 and subsequently Section 106 was removed and Section 109 of
