The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 3603.54 litres of IMFL is stated to have been recovered from a truck of which the petitioner was the driver.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession or from the vehicle in question. He is in custody since 21.3.2020 and chargesheet has been submitted in the case. It is further

Patna High Court CR. MISC. No.11230 of 2021(17) dt.06-01-2022 2/2 submitted that a supplementary affidavit has been filed enclosing with the same a copy of the receipt in evidence of the petitioner having deposited Rs.10,000/ with the Patna High Court Legal Services Committee.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner not having any criminal antecedent under the Bihar Prohibition and Excise Act, 2016, the Court directs the petitioner to be enlarged on bail in connection with Industrial Area P.S. Case no.32 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Excise Court, Vaishali at Hajipur on the following conditions:

(i) that one of the bailors of the petitioner shall be his close relative.

(ii) the other bailor of the petitioner shall be a resident of a place within the jurisdiction of the learned trial court. (Partha Sarthy, J) Saurabh/- U T
