Petitioner seeks bail in a case registered for the offences punishable under Sections 302,201,323,325,120(B),34 I.P.C.
According to FIR, four others took to the son of the informant on a four wheeler and thereafter dead body of the son of the informant was found near the railway track. Allegation is that everything happened at the instance of the petitioner. Learned counsel for the petitioner submits that the petitioner is in custody since 12.10.2020. Petitioner has got no criminal antecedent. There is no eye witness of the occurrence. Learned counsel for the informant opposed the prayer
Patna High Court CR. MISC. No.10252 of 2021(2) dt.30-06-2021 2/3 for bail on the ground that in the statement under Section 164 Cr.P.C. Vivek Kumar stated that the petitoner had asked others to commit murder of the deceased. Moreover the accused persons are putting pressure and threat for compromise in the case.
Considering the nature of material against the petitioner and completion of investigation, in my view, the petitioner deserves prayer for bail, accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Jagdispur Police Station Case No.143 of 2020 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
(d) If the learned Trial Court would come to the notice that there is substantiated allegation of tampering with the
