JUSTICE SANJAY PRIYA ORAL ORDER 15-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 379, 420, 411 of the Indian Penal Code and Sections 3, 4 and 5 of Bihar Illegal Mines Act.

It is alleged in the written report that while the informant was on patrolling duty, he saw the tractor loaded with sand coming from G.T. road side. The driver was asked to stop, but he managed to escape and left the tractor at the place of occurrence.

It has been submitted that the petitioner was owner of the tractor. He was not present at the place of occurrence. He has no concern with the sand loaded by the driver on the aforesaid

Considering the facts and circumstances of the case, let the petitioner above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Barun P.S. Case No. 194 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
