JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 18-12-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Madanpur P.S. Case No. 45 of 2018 for the offence under Sections 4(1), 4(1A) of MMDR Act, 1957 and Section 26A, 27/40 of Bihar Minor & Mineral Rules, 1972.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He submits that the similarly circumstanced other co-accused, namely, Rakesh Kumar Singh @ Rakesh Kumar Sinha, Ravindra Kumar singh, Vijay Kumar Ravi and Satyendra Yadav, have been granted anticipatory bail vide order dated 16.06.2018 in Cr. Misc. No. 32249 of 2018, vide order dated 17.05.2018 in Cr. Misc. No. 30233 of 2018, vide order dated 07.09.2018 in Cr. Misc. No. 52323 of 2018 and order dated 10.12.2018 in Cr. Misc. No.

Patna High Court Cr.Misc. No.74391 of 2018(2) dt.18-12-2018 2/2 61596 of 2018 respectively.

Considering the aforesaid, the petitioner named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No. 45 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
