JUSTICE MUNGESHWAR SAHOO ORAL ORDER 16-02-2017 From perusal of the order dated 19.01.2017 passed in Title Partition Suit No.220 of 2010 by Subordinate Judge-XI, Patna, it appears that the court below found that there is already pleading regarding Yadast Partition and, therefore, permitted the plaintiff to file the copy of the said Yadast Partition in support of the proof of pleading regarding Yadast Partition. The court below also found that because this fact has already been pleaded, the defendant would not be surprised if the plaintiff is permitted to produce the said document.

In view of the aforesaid facts and circumstances of the case, I find no reason to interfere with the impugned order in exercise of supervisory jurisdiction. Accordingly, this civil miscellaneous application is dismissed.
