Petitioner seeks bail in Nawada Town PS Case No. 738 of 2018 registered under Sections 272, 273 of the IPC and Section 30(a) of Bihar Prohibition and Excise Act, 2016. Counsel for the petitioner submits that he has falsely been implicated in this case. He has clean antecedent and is in custody since 11.10.2018. The recovery of 200 litres of toddy is attributed from the Thela with which he has no concern and the seizure is not in accordance with procedure prescribed under Section 100 Cr.P.C.

Considering the aforesaid submissions as also the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released
