JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 22-12-2017 It has been pointed out by the learned counsel appearing on behalf of the University that the petitioner has been wrongly described in the cause title of the application. Learned counsel for the petitioner is permitted to make necessary correction in the cause title of the application in course of the day.

3. The petitioner is aggrieved by constitution of Adhoc Committee of Dev Bharati Sanskrit UP Shashtri Mahavidhyalaya Uchechirma under Gaya District. It is her contention that she was earlier Secretary of the Governing
Patna High Court CWJC No.1523 of 2017(2) dt.22-12-2017 2/2 Body of the College but without giving notice to her, the University has constituted Adhoc Governing Body in exercise of power under Section 60 (4) of the Bihar Universities Act, which was not required.

There is nothing on record to show that a Governing Body was earlier constituted though from Annexure-1 it appears that for the purpose of constitution of full Governing Body of the College, the University had approved the names of some of the members of the Governing Body in the year 2015. More than a year has elapsed from the date of the constitution of the said Adhoc Committee by the University by impugned notification.
5. In the facts and circumstances of the case, I dispose of the writ application with a direction to the Vice-Chancellor and the Registrar of the University to ensure constitution of the Governing Body strictly in accordance with the statutory provisions within a period of three months from the date of receipt/production of a copy of this order.
