ANJANA MISHRA ORAL ORDER 26-09-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

Petitioners are apprehending their arrest in connection with Manpur P.S. Case No. 19 of 2016 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 353, 333, 224 and 225 of the Indian Penal Code and 47(a)/61 of Excise Act. Counsel for the petitioners submits that there is inordinate delay in lodging the present FIR and the allegations are wholly misconceived and not the correct. It is further submitted that nothing has been seized from the conscious possession of these petitioners and they are having clean antecedents. Considering the nature of allegation made and that

No.32702 of 2016 (2) dt.26-09-2016 2/2 there is no recovery of liquor from the conscious possession of these petitioners, let the petitioners above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, West Champaran at Bettiah in connection with Manpur P.S. Case No. 19 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
