JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-01-2019 Petitioners apprehend their arrest in connection with Brahampura P.S.Case No. 16 of 2012 registered for the offences punishable under Sections 420, 467, 468, 471 and 34 of the Indian Penal Code.
Allegation as per FIR is that petitioners have filed forged rent receipt in Title Suit No. 190 of 2009.
Submission of learned counsel for the petitioners is that petitioners they have executed a power of attorney in favour of Ramanand Prasad and thereafter Ramanand Prasad has executed another power of attorney in favour of his wife and the said title suit has been filed by the wife of Ramanand Perasad and no paper has been filed by the petitioners in that case and as such they have falsely been implicated and wife of Ramanand Prasad has been granted privilege of anticipatory bail by a co-ordinate Bench of this Court
Patna High Court Cr.Misc. No.78270 of 2018(2) dt.07-01-2019 2/2 vide order dated 8.5.2018 in Cr.Misc.No. 26721 of 2018. Heard learned APP also.
Having heard both sides and in the facts and circumstances, as stated above, let petitioners, above named, surrender within a period of six weeks from the receipt of this order and on surrender they shall be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Brahampura P.S.Case No. 16 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that petitioners have to co-operate in investigation, otherwise their bail bonds shall be cancelled.
