2. The petitioner seeks bail in connection with Turkauliya P.S. Case No. 466 of 2023 instituted for the offences punishable under Section 304, 308, 201 and 34 of the Indian Penal code and Section 33, 34, 37, 41 of the Bihar Prohibition and Excise Act.
3. The prosecution case is based on a written report alleging therein the informant who happens to be Sub-Inspector has received an information that few persons had falled sick under mysterious circumstances in Jaisinghpur, Gokhula, Madhopur, Mathurapur are under Turkauliya jurisdiction among
Patna High Court CR. MISC. No.57100 of 2024(2) dt.17-01-2025 2/3 them some have died during the course for treatment and their dead bodies cremated in haste by relatives. The informant went to the respective areas and on interrogation, it as found that the deceased persons fallen ill and died during the course or treatment due to consumption of some poisonous substance.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that he has clean antecedent. He further submits that petitioner is not named in the F.I.R.. The name of the petitioner has transpired in this case during the course of investigation. The co-accused persons has already been granted anticipatory bail by the Coordinate Bench of this Court vide order dated 30.08.2023 passed in Cr. Misc. No. 57383 of 2023, vide order dated 19.02.2024 passed in Cr. Misc. No. 7372 of 2024, vide order dated 08.11.2023 passed in Cr. Misc. No. 56535 of 2023, vide order dated 04.03.2024 passed in Cr. Misc. No. 83354 of
5. Learned counsel for the State opposes the prayer for bail of the petitioner
6. Considering the aforesaid facts and circumstances of the case as well as the fact that the F.I.R. is against unknown persons, let the above named petitioner be released on bail in the
Patna High Court CR. MISC. No.57100 of 2024(2) dt.17-01-2025 3/3 event of his arrest or surrender before the trial Court within a period of six weeks from today on furnishing bail bond of Rs 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Court No. 1, East Champaran in connection with Turkauliya P.S. Case No. 466 of 2023 subject to the condition laid down under Section 438(2) of Cr.P.C.
