30-11-2016 Heard Sri Sanjay Kumar Tiwary, learned counsel for the petitioner, learned Addl. Public Prosecutor as well as Sri Shailendra Kumar Singh, learned counsel, who has appeared on behalf of opposite party no. 2/Bihar State Food Corporation. The petitioner, who is a rice miller, has prayed for grant of anticipatory bail in Kudra P.S. Case No. 187 of 2016 registered for offence under Sections 409 and 420 of the Indian Penal Code.
At the very outset, learned counsel for the petitioner offered to pay entire alleged misappropriated amount. The Court is of the opinion that if the petitioner within a period of six weeks from today appears before the court
Patna High Court Cr.Misc. No.32191 of 2016 (5) dt.30-11-2016 2/2 below and files a petition for grant of regular bail and if at that very time, the petitioner offers to pay entire misappropriated amount, the learned court below, without being prejudiced with this order, may examine the same and pass appropriate order in accordance with law.
It is made clear that this Court has not recorded any opinion on the merit of the case.
The petition stands disposed of.
