The petitioner is apprehending arrest in a case registered for the offences punishable under sections 147,149,379,384,307,427,504 and 506 of the Indian Penal Code. It is alleged that the accused persons including the petitioner came variously armed. The petitioner armed with pistol, went to the shop of the informant asking the informant why extortion amount of rupees ten thousand was not being paid and robbed the articles. Thereafter, the accused persons made assault to the informant and took away cash of rupees thirty five thousand, damaged the computer and other

It is submitted by the learned counsel for the petitioner that specific accusation of assault is against Mithu Kumar alias Matho Kumar and Rohit Kumar and the accusation of assault is not specific against the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Bihar P.S. Case No. 280 of 2015 pending in the court of learned CJM, Naland at Biharsharif. This application is disposed of with the aforesaid observation/direction.
