The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code.
The prosecution case is of enticing away the minor daughter of the informant by Lalu Sharma with the help of others. Though, the petitioner is not named in the FIR but in 164 Cr.P.C. statement the victim has named this petitioner as the person, who was driving the motorcycle on which she was being taken away. It is also alleged that this petitioner also ravished her.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.41064 of 2015 (2) dt.06-10-2015 2/2 petitioner that the informant has retracted from the initial version and filed a petition to that effect before the learned court below. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Baheri P.S. Case No. 24 of 2013 pending in the court of learned Chief Judicial Magistrate, Darbhanga.
With the aforesaid observation, this application is disposed of.
