ANJANA MISHRA ORAL ORDER 29-08-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners are apprehending their arrest in Daraunda P.S. Case No. 70 of 2016, registered for the offences punishable under Sections 188, 419, 420, 467, 468, 471, 120(B) of the Indian Penal Code.
Learned counsel for the petitioners submits that the present case has been lodged only on account of some election dispute. It appears that it is a trap case. Petitioners have falsely been implicated in the case due to local politics. Considering the aforementioned facts and circumstances and that the petitioners have no criminal antecedent,
Patna High Court Cr.Misc. No.29787 of 2016 (2) dt.29-08-2016 2/2 let the petitioners in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VIII, Siwan in connection with Daraunda P.S. Case No. 70 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
