JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 420, 34 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case is that one Sanjay Yadav caused fire arm injury to the informant in the background of some money dispute. The informant was taken to the clinic of Dr. Rahman. It is alleged against the petitioner that this petitioner subsequently came to the clinic of Dr. Rahman and forcibly tried to take the informant to Madhepura for treatment and when family members of the informant made protest then this petitioner abused and made assault. It is submitted by learned counsel for the petitioner that petitioner wanted to give better medical facility to the informant, when no injury was caused by the petitioner.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Purnea in connection with Janki Nagar P.S. Case No. 38 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
