ANJANA MISHRA ORAL ORDER 19-11-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner apprehends his arrest in connection with Tekari P.S. Case No. 07 of 2016 for the offences registered under Sections 395 and 397 of the Indian Penal Code. Learned counsel for the petitioner submits that though the petitioner is not named in the first information report yet his name has been brought in connection with the present case on the basis of the confessional statement made before the police by co-accused persons, namely, Ravi Kant Kumar @ Vidhayak Jee, Bimlesh Kumar and Surya Kumar @ Parmendra Kumar. It is further submitted that such statement made before the police has no evidentiary value.
Considering the aforesaid facts and circumstances of the
Patna High Court Cr.Misc. No.32366 of 2016 (2) dt.19-11-2016 case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IX, Gaya, in connection with Tekari P.S. Case No. 07 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
