JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2018 The petitioner seeks bail in connection with Forbesganj P.S.Case No. 457 of 2016 registered under Sections 147, 148, 149, 302, 323, 325 and 341 of the Indian penal Code. Allegation against the petitioner and all accused persons is of assaulting the husband of the informant by Lathi, Danda and Farsa.

Submission of learned counsel for the petitioner is that all family members have been made accused in this case and no specific allegation has been attributed against them and he is in custody for more than three months, and charge sheet has been submitted.

Heard learned APP also as well as learned counsel appearing on behalf of the informant opposed the prayer of bail. Having heard both sides and in the facts and

No.74782 of 2018(2) dt.18-12-2018 2/2 circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Araria in connection with Forbesganj P.S. Case No. 457 of 2016 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
