2. The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code.
3. According to prosecution case, Neha Begum married Muntajir Alam on 21.09.2019 and gave Rs.2,00,000 plus a motorcycle as dowry. The accused later demanded another Rs.1,00,000 and a refrigerator and allegedly subjected her to mental and physical harassment. Despite having two children, she was forced to leave the matrimonial home. A panchayati failed to resolve the issue, leading her to file the

Learned counsel for the petitioner submits that pursuant to the order dated 12.08.2025, the matter was sent for mediation and the dispute between the parties have been resolved through mediation, which report is kept at Flag 'M' of the anticipatory bail application being Mediation Report No.1188 of 2025.
5. Learned counsel for the O.P. No.2, at this stage, submits that some protection be granted to the O.P. No.2 that in case of any further harassment being caused, she may approach the appropriate forum / authority and shall be at liberty to file cancellation of bail bonds of the petitioner.
6. Considering the aforesaid facts and circumstances that the matter has already been resolved by the process of mediation, accordingly, this Court is inclined to grant the privilege of anticipatory bail to the petitioner.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria, in connection with Araria

No.52277 of 2025(3) dt.15-11-2025 3/3 Complaint Case No. 1178C of 2024, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure / Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita and with other following conditions:- (i) one of the bailors should be the family member/relative of the petitioner(s) who shall provide official document to show his/her bona fide;
(ii) the petitioner(s) shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his/her/their bail bond by the Trial Court itself; (iii) the petitioner(s) shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(iv) the petitioner(s) shall desist from committing any criminal offence again and if the O.P. No.2 is ever subjected to any harassment or torture of any kind, the O.P. No.2 or the State shall be at liberty to take steps for cancellation of their bail bonds. (Ajit Kumar, J) sharun/- U T
