In this case, a limited prayer has been made by the petitioner that against the order dated 31.10.2016 passed by the licensing authority i.e. the Sub-Divisional Officer, Gogari, Khagaria, he has filed an appeal before the Collector, Khagaria, who is the Appellate Authority but, he is sitting tight over the matter and has not passed any order.

In that view of the matter, the Collector, Khagaria is directed to consider the appeal of the petitioner and dispose of the same by passing a reasoned order within a period of three months from the date of receipt/production of a copy of this order. Before

Patna High Court CWJC No.2715 of 2017 dt.03-04-2017 disposing of the matter, the Collector, Khagaria will give an opportunity of hearing to the petitioner.

This Court has not given any opinion on the merit of the case.

With the aforementioned observation and direction, this application is disposed of.
