The petitioner seeks regular bail in connection with Gadhpura P.S. Case No. 5 of 2018 registered for the offence punishable under Sections 385 and 392 of the Indian Penal Code.

The allegation is regarding unknown accused persons having intercepted the informant and snatched a sum of Rs. 1,82,000/-. According to the informant, one Lalua is said to be main accused in the present case.

The learned counsel for the petitioner has submitted that the petitioner is not named in the FIR and the specific allegation is against the co-accused, namely, Lalua and not the petitioner herein. It is submitted that no T.I. Parade has been

Patna High Court Cr.Misc. No.77080 of 2018(2) dt.11-01-2019 2/2 held till date and no recovery has been made from the petitioner herein. It is further submitted that similarly situated co-accused persons have already been granted bail by this Court by orders dated 07.06.2018 passed in Criminal Misc. No. 33087 of 2018 and 30.08.2018 passed in Criminal Misc. No. 52687 of 2018. The petitioner is stated to be having a fair antecedent barring one case in which he is on bail and he is languishing in custody since 03.03.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Begusarai in connection with Gadhpura P.S. Case No. 5 of 2018.
