2. The petitioner is apprehending his arrest in connection with Complaint Case No. 308(c)/2023 for the offence under Sections 323, 341, 498A, 354, 313 of the I.P.C. and section 3 & 4 of D.P. Act.

3. It is a case of matrimonial dispute between the parties in which there is allegation on the petitioner regarding abusing and assaulting the complainant for demand of dowry.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case, he is innocent and he has not committed any offence. The name of the petitioner is appended at serial No. 2 of the complainant petition and he happens to be unfortunate husband of the complainant.

5. Learned APP opposes the prayer for bail.

During course of argument, learned counsel for both the parties submits that earlier this case was referred to the Mediation Centre, Patna High Court, Patna where the matter was amicably settled between the parties and agreement was made on 21.02.2025 and presently the O.P. No. 02 is living at her matrimonial home and both the parties are ready to comply the terms and conditions mentioned in mediation report of agreement dated 21.02.2025 (Mediation Proceeding No. 107 of 2025) arising out of Cr. Misc. No. 55790 of 2024.

Keeping in view the aforesaid facts, this Court is inclined to enlarge the petitioner on anticipatory bail provisionally, in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, West Champaran , in connection with Bettiah Complaint Case No. 308(c)/2023 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
