JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-02-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 302, 201/34 of the Indian Penal Code.

It is alleged that one Mutur Yadav killed Degree Choudhary. Thereafter, the villagers became furious and they surrounded and killed said Mutur Yadav.

Learned counsel for the petitioner submits that the FIR is against unknown and petitioner has been made accused only on the basis of viral video and except the same same no other substantive evidence has been collected during course of investigation to suggest the implication of this petitioner in the present case. Petitioner has claimed clean antecedent and he is in custody since 24.8.2021.

Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in Udwantnagar Police Station Case No. 170 of 2021.
