It is fairly submitted on behalf of the petitioner that earlier he had approached before this Court in CWJC No. 15762 of 2017, which came to be dismissed vide order dated 03.11.2017 as not maintainable. However, liberty was granted to the petitioner to avail his remedy before the appropriate forum.

3. Pursuant to the liberty granted by this Court, a

Patna High Court CWJC No.3633 of 2021 dt.12-01-2024 2/3 representation was made before the Central Registrar, Department of Co-operative, Ministry of Agriculture, Krishi Bhawan, New Delhi. However, despite the representation and the reminders, the same has not been answered, compelling the petitioner to approach before this Court.

4. Submission has been made that the petitioner superannuated on 31.10.2015 from the post of Driver in the office of the Bihar State Land Development Bank and till date, he has not been accorded his admissible retiral benefits, including Group Insurance, GPF, Gratuity, Leave Encashment along with statutory interest thereon, apart from revision of pay scale.

Considering the submissions advanced on behalf of the petitioner and also taking into account the fact that on earlier round of litigation, this Court had held that the present writ petition is not maintainable in view of the judgment rendered by the Special Bench of this Court in the case of The Organizer, Dehri C.D. & C.M. Union Limited vs. The State of Bihar & Ors. reported in 2014(1) PLJR 695, the writ petition stands disposed of with a hope and expectation that the Central Registrar, Department of Co-operative, Ministry of Agriculture, Krishi Bhawan, New Delhi shall consider the claim of the

Patna High Court CWJC No.3633 of 2021 dt.12-01-2024 3/3 petitioner and dispose of the same by a reasoned and speaking order, in order to meet the ends of justice, in case the petitioner files a fresh representation, preferably within a period of four weeks.

7. With the aforesaid observation, the present writ petition stands disposed of.
