JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 21-01-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual Court proceedings. Learned counsel for the petitioner undertakes to remove the defects within four weeks of resumption of normal court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.

The present application has been filed for modification of order dated 08.10.2015 passed in Cr. Misc. No. 22046 of 2015 to the extent of extending the period of surrender. On the grounds mentioned in the modification application as also on the undertaking given by learned counsel

Patna High Court CR. MISC. No.65186 of 2021(2) dt.21-01-2022 2/2 for the petitioner that the petitioner is ready to return the dues of farmers to the tune of Rs.7,23,896.00 (Rupees Seven Lakhs Twenty Three Thousand Eight Hundred and Ninety Six) only, the period of surrender is extended by six weeks from the date of receipt/production of a copy of this order in connection with Piro P.S. Case No. 152 of 2015, pending in the Court learned Additional Chief Judicial Magistrate, Bhojpur at Ara, subject to deposit of sum of Rs.2000/- (Rupees Two Thousand) in the Victim Compensation Fund.

The learned Court below is directed to accept the bail bond of the petitioner after satisfying that the aforesaid amount has been paid to the farmers.

The order dated 08.10.20215 is modified to the extent as indicated above.

Accordingly, this modification application stands disposed of.
