Petitioner is apprehending her arrest in connection with Hilsa PS Case No. 394/2013 for the alleged offence under Sections 304(B), 201, 34 of the Indian Penal Code. Learned counsel representing the petitioner submits that petitioner has no criminal antecedent. He further submits that petitioner is the married sister of the husband of the deceased. She was married 25 years back and she is happily residing at her matrimonial house.
Considering that the petitioner is the married sister -in-law of the deceased and there is no criminal antecedent and also the fact that the husband and the mother-in-law of the deceased are in judicial custody, this application is allowed. Accordingly, in the event of arrest or surrender before
Patna High Court Cr.Misc. No.75877 of 2018(2) dt.21-12-2018 2/2 the court below within a period of one month from today, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Hilsa, District Nalanda in connection with Hilsa PS Case No. 394/2013 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
