JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 18-07-2016 The present application under Section 53 of the Juvenile Justice (Care and Protection of Children) Act, 2000 has been preferred against the order dated 24.04.2014 passed by the Juvenile Justice Board, Muzaffarpur in Ahiyapur P.S. Case No. 313 of 2005 whereby the earlier order dated 19.01.2012 declaring the petitioner juvenile has been recalled.
At the outset, it was pointed out by the Court that the impugned order is appealable. Learned counsel for the petitioner fairly concedes to this observation of the Court and seeks leave to file appeal against the impugned order.
In view of availability of the statutory alternative remedy to the petitioner, I am not inclined to entertain the present
Patna High Court CR. REV. No.645 of 2014 (3) dt.18-07-2016 2/2 revision application. Accordingly, the application is permitted to be withdrawn with liberty to the petitioner to agitate his grievance before the appellate court.
