JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-02-2017 Heard the learned counsel for the petitioner. The petitioner is apprehending his arrest in connection with Arer P.S. Case No. 20 of 2016 registered for the offences under Sections 341, 323, 324, 307, 379, 435, 504/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that allegation against the petitioner is that he assaulted the informant thrice, but the injury report, Annexure-2, shows that injuries on the person of the informant was simple in nature. Heard the learned APP also.

Having heard both sides and in view of the fact that there is repetition of blows made by the petitioner, though the injuries are simple in nature, I am not inclined to grant anticipatory bail to the petitioner. Let the petitioner, named above, surrender in the court below and pray for regular bail who shall consider the allegation as well as the fact that the injuries were simple in nature, and shall dispose of the application, if possible, on the same day.
