====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 19-12-2018 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Rail G.R.P. Kiul P.S. Case No. 155 of 2018 instituted for the offence under Sections 401 and 414 of the Indian Penal Code.
In the written report it is alleged that informant who is ASI of Rail Police heard sound of "Chor-Chor" from compartment of Kiul DMU Passenger. The informant reached there and found three persons attempted to run away. One person has been caught who disclosed his name as Anil Kumar Saw (petitioner).
Counsel for the petitioner submits that petitioner has been arrested merely on suspicion. He is in custody since
Patna High Court Cr.Misc. No.75752 of 2018(2) dt.19-12-2018 2/2 28.7.2018. There is no recovery of any stolen article from possession of the petitioner.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-cum-Rail Magistrate, Kiul, Distt. Lakhisarai, in connection with Rail (G.R.P.) Kiul P.S. Case No. 155 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
