The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 504, 308, 354, 506, 34 of the Indian Penal Code.

As per the prosecution case, this petitioner alongwith other F.I.R. named co-accused persons are alleged to have abused and assaulted the informant.

It is submitted on behalf of petitioner that specific accusation of assault is against co-accused Kameshwar Paswan and Ramesh Paswan. So far as this petitioner is concerned, there is no specific allegation of assault against him. In fact, the present case is counter blast of Mahila P.S. Case No. 268 of 2021. Admittedly, the occurrence took place due to land dispute between the parties. The injury has been found to be simple in nature by the doctor. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.63434 of 2021(4) dt.22-08-2022 2/2 Learned counsel for the State and Informant vehemently opposed the prayer for anticipatory bail and submitted that petitioner and other co-accused persons are also alleged to have violated a proceeding under Section 107 of Cr.P.C.

However, considering the aforesaid facts and circumstances as well as clean antecedent of petitioner, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-I cum Special Judge, Kaimur at Bhabhua in connection with Mohania P.S. Case No. 269 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
