JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 16-12-2015 Heard learned counsel for the petitioner and the State. In the year 2010, the petitioner was posted at Darbhanga as incharge Assistant Settlement Officer, Madhubani. He was put under suspension vide order dated 06.03.2014 passed by the Director, Panchayati Raj Department, Government of Bihar on the ground of being trap while taking bribe.

Patna High Court CWJC No.12900 of 2015 (3) dt.16-12-2015 2 / 2 The petitioner denies the allegation and submits that even as per the department's case, it was Pawan Kumar Chaudhary, a private person, who accepted bribe and not the petitioner. The petitioner submits that the impugned order of suspension is bad and is not sustainable in the law. The petitioner submits that this morning he has received a typed copy of office order dated 09.11.2015 of Panchayati Raj Department, whereby his suspension order has been revoked, as such the main relief of the petitioner stands redressed.

It goes without saying that the petitioner would be entitled to subsistence allowances for the period he has remained in suspension, provided that he has not been paid, within a period of two months from the date of receipt of a copy of this order. This application stands disposed of.
