1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Ghorasahan Police Station Case No. 263 of 2024, disclosing offences under Sections 341, 323, 324, 307, 504, 506, 34 of the Indian Penal Code.

3. As per the First Information Report, on 07.06.2024, while the informant was cultivating his land, all the accused persons, armed with lathi, danda and sharp cutting weapon came there and attacked the informant. Petitioner assaulted the informant with Tanguli (small axe) due to which he received injury on his head.

4. Mr. Verma, learned Counsel appearing for the petitioner submits that there is delay of four days in lodging of the FIR and the injury caused to the informant is simple in

Patna High Court CR. MISC. No.56896 of 2024(2) dt.04-09-2024 2/2 nature as would be evident from Annexure 2. Both the parties are agnates having land dispute.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that both the parties are related, there is land dispute between the parties and injury caused to the informant is simple in nature, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sikrahna at Dhaka, East Champaran, Motihari, in connection with Ghorasahan Police Station Case No. 263 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
