The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366/34 of the Indian Penal Code and Section 8 of the POCSO Act. It is a case of abduction of the informant's daughter by the accused persons including the petitioner. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. Petitioner has got clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail and submitted that the victim in her statement recorded under Section 164 of the Cr.P.C. stated that her age is about 15-16 years and also asserted that three boys

Patna High Court CR. MISC. No.63428 of 2021(3) dt.12-07-2022 2/2 kidnapped her including the petitioner. She further supported the case of the prosecution.

Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner is rejected.
