====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 28-10-2021 Heard the parties.
Let the defect(s), if any, be removed within four weeks after complete start of the physical Court. Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 302, 506 of the Indian Penal Code and Section 27 of the Arms Act.
Petitioner is assailant of his step-brother. Petitioner is in custody since 14.08.2020.
Learned counsel for the petitioner submits that there is sharp contradiction in the statement of the informant in the FIR and under Section 161 Cr.P.C.
The report of the learned Trial Judge dated 18.08.2021 would reveal that the case is at the stage of prosecution evidence. However, no prosecution witness has turned-up.
Patna High Court CR. MISC. No.10166 of 2021(5) dt.28-10-2021 2/2 Considering the nature of allegation against the petitioner, I am not inclined to enlarge him on bail in connection with Dumraon (Naya Bhojpur) P.S. Case No. 285 of 2020 pending in the Court of learned Chief Judicial Magistrate, Buxar.
Hence, prayer for bail is refused.
Learned trial court is directed to expedite the trial of the case.
