JUSTICE CHAKRADHARI SHARAN SINGH) 21-01-2022 Following is the relief the petitioner is seeking : "That this application is being filed on behalf of the petitioner challenging the order contained in Memo no.1860 dated 23.08.2020 passed by the District Agriculture Officer, Aurangabad by which he was pleased to cancel the fertilizer retail license of the petitioner being license no.FMK06081800819 granted under the provisions of the Fertilizer Control Order, 1985 and further be pleased to restore the fertilizer retail license of the petitioner."
Undoubtedly, the petitioner has remedy of appeal against the said order dated 23.08.2020, which he has not

Considering the facts and circumstances, this application is disposed of with a liberty to the petitioner to prefer appeal against the impugned order. If he files an appeal within four weeks from today with an application seeking condonation of delay, the same shall be considered liberally and the petitioner's appeal should be decided on merits by the appellate authority expeditiously, preferably within a period of three months from the date of filing of the appeal.
