Mr. Umesh Narayan Dubey, AC to GP-27 ====================================================== CORAM: HONOURABLE MR. JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 02-01-2018 Heard learned counsel for the parties.

2. The petitioner claims that he had donated a piece of land for construction of a School at Hathiyahi Kushwaha Tol, Khajauli in the district of Madhubani. He wants his name to be added with the name of the School. He seeks a direction from this Court to that effect. He is said to have approached the authorities for the said purpose by way of representations, which have been brought on record by way of Annexures-8,9 and 10 to the writ applications.

3. A counter affidavit has been filed bringing on record the policy of the State Government of having name of the donor of

Patna High Court CWJC No.1555 of 2017(4) dt.02-01-2018 2/2 the land for construction of School with the name of the School. Name of only such donor who donates 20 decimals or more land can be added with the name of the School. The land which the petitioner has donated is admittedly less than 20 decimals.

4. In any view of the matter, this Court cannot issue a direction prescribing nomenclature of the School. It is purely an executive function.

5. Learned counsel for the petitioner informs that the petitioner's representation has still been kept pending as some one else is also claiming his name to be included with the existing name of the School.

6. It will be open to the authorities to take a decision either this way or that way in this regard.

7. I just dispose of this writ application with an observation that the competent authority should take decision within six months from the date of receipt/production of a copy of this order, strictly in terms of the policy decision of the State Government, if the decision has already not been taken.

8. This disposes of the application.
