The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 467, 468, 469, 470, 419 and 420/34 of the Indian Penal Code. It is alleged that one Pramod Kumar was appearing in place of the petitioner at the Railway Recruitment Examination.
It is submitted by learned counsel for the petitioner that the petitioner has no knowledge about appearance of Pramod Yadav in his place and even assuming the accusation no offence under Section 420 IPC is made out. This Court is not inclined to interfere only
Patna High Court Cr.Misc. No.39387 of 2015 (2) dt.05-10-2015 2/2 because the case was registered in 2008, but in the facts and circumstances of the case, it is a case for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Khajekala P.S. Case No. 181 of 2008 pending in the court of learned Additional Chief Judicial Magistrate, Patna City.
With the aforesaid observation, this application is disposed of.
