The present application has been filed for modification of the order dated 25.1.2012 passed in Cr. Misc. No. 15949 of 2010 by Hon'ble Mr. Justice Akhilesh Chandra (since retired) for extending the period of surrender. The petitioner was granted anticipatory bail vide order dated 25.1.2012 in Complaint Case No. 861 of 2006 wherein process was directed to be issued after cognizance being taken under section 466 IPC and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act. Since the order sought to be modified is dated 25.1.2012 and the present modification application has been filed on 27.8.2015, this court is not inclined to interfere in the matter.

No.41077 of 2015 (2) dt.07-10-2015 2/2 Let the learned court below consider the prayer for regular bail of the petitioner, preferably on the same day, keeping in view the fact that the petitioner was granted anticipatory bail on merits, in case the petitioner surrenders within six weeks from today in connection with the Complaint Case No. 861 of 2006 pending in the court of learned C.J.M. Nawada.

This application is disposed of with the aforesaid observation/direction.
