JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-07-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 353, 354, 341, 323/34 of the Indian Penal Code.
The prosecution case is that on 11.04.2015 the informant inspected different Aangabari Centers of Maner and in course of inspection Code No. 202 was found closed. After inspection when the informant came to her office and started discharging her official duties then petitioner No.1, husband of Aanganbari Sevika of Code No. 202, came and abused the informant and also assaulted her. Petitioner No.1 caught the hand of the informant and dragged her. After some time petitioner No.2 came and threatened the informant.
It is submitted by the learned counsel for the petitioners
Patna High Court Cr.Misc. No.28280 of 2016 (2) dt.14-07-2016 2/2 that at earlier point of time petitioner No.1 has filed complaint before the District Magistrate on 18.04.2015 against the informant thereafter the informant lodged the present case and even assuming the accusation no case under sections 353 or 354 of the IPC is made out.
Considering the aforesaid facts, in view of this court, it is a case for consideration of the prayer for regular bail of the petitioners by the learned court below in case the petitioners surrender within six weeks from today in connection with Maner P.S. case No. 216 of 2015 pending before Sri Randhir Kumar, learned Judicial Magistrate, 1st class, Danapur, Patna. This application is disposed of with the aforesaid observation/ direction.
