The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code.

petitioner is husband of the deceased. He is alleged to have committed murder of his wife/daughter of the informant. Learned counsel for the petitioner submits that the marriage had taken place 10 years back and there are two children out of the wedlock and there was no occasion to commit murder of informant's daughter. As a matter of fact, she committed suicide by hanging and the petitioner has got no concern with the incident. He submits that during investigation

Patna High Court CR. MISC. No.63538 of 2021(3) dt.12-04-2022 2/2 the only material that has come against the petitioner is that the deceased committed suicide due to quarrel with the petitioner. Petitioner is in custody since 22.6.2021.

Learned counsel for the State opposes the prayer for bail and submits that there is specific allegation against the petitioner that he along with co-accused Mira Devi killed the deceased in a planned conspiracy. Post mortem report also shows that the death occurred due to throttling. Considering the rival submissions of the parties and the fact that the petitioner is the husband of the victim who died in suspicious condition at her matrimonial home, his prayer for bail is refused.
