ANJANA PRAKASH ORAL ORDER 19-08-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in Complaint case No. C2-11 of 2013 registered under Section 47(A) of the Excise Act, pending before the court of Sub Divisional Judicial Magistrate, Sitamarhi.
The Petitioners were allowed anticipatory bail by order dated 10.2.2014 vide Cr.Misc.No.42590 of 2013 but on submission that the Petitioners have fair antecedents. Since there were three other cases pending against him, such an affidavit could not be filed and hence the second application for anticipatory bail.

Patna High Court Cr.Misc. No.9184 of 2015 (2) dt.19-08-2015 2/2 maintainable, the same is disposed of with a direction to the Petitioners to surrender in the court below which shall consider the fact that the Petitioners on merits was found fit to be released on anticipatory bail.
