The petitioner is in custody since 16.03.2018 in connection with Kasba P.S. Case No.52 of 2018 registered under Sections 363, 366A, 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the entire allegation is false and frivolous and cannot be used against the petitioner as during the course of the trial, the informant as well as his daughter, the victim, has now given evidence contrary to the allegations as made out in the F.I.R. It is submitted that both the witnesses have now turned hostile and now nothing much remains to be decided at the trial. It is further submitted that the petitioner has no criminal antecedent. No.76864 of 2018(2) dt.10-01-2019 2/2 circumstances and in view of Annexure-3 series, which are the depositions made in Sessions Trial No.269 of 2018, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of IVth Additional Sessions Judge, Purnea in connection with Kasba P.S. Case No.52 of 2018.
