JUSTICE MADHURESH PRASAD ORAL ORDER 04-01-2023 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing for the State of Bihar. Having regard to the heinous nature of allegation and after going through the materials collected in the course of investigation, the petitioners' prayer for bail was earlier rejected on 25-05-2021 ( Annexure-1). The prayer has been renewed by way of instant bail application.

The Court had earlier requisitioned a report regarding the stage of trial. Pursuant to which, report has been received from the Court of learned 20th Additional District and Sessions Judge, Muzaffarpur.

Report reveals that three prosecution witnesses out of seven have been examined. Report to this effect is of 01-12-2022. Since the trial has already commenced and is nearly half way through,

Patna High Court CR. MISC. No.53555 of 2022(4) dt.04-01-2023 2/2 at the time of transmission of report, this Court is not inclined to take a different view today. The application is rejected with an observation that the learned Trial Court will take all steps to ensure expeditious conclusion of the trial without granting any undue delay or unnecessary adjournment preferably within a period of six months.
