The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504 and 354/34 of the Indian Penal Code. It is alleged that the petitioner assaulted the informant on the head with iron rod when the wife and neighbour came to rescue they were assaulted by the petitioner and Dhupnath Prasad and Ishwar Chand Prasad assaulted with Garasa to Pramila Devi.

It is submitted by learned counsel for the petitioner that the injuries have been found to be simple in nature. The petitioner is the own brother of the informant and in

Patna High Court Cr.Misc. No.40618 of 2015 (2) dt.01-10-2015 2/2 the background of dispute and pending title suit the accusation has been levelled.

The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Maharajganj P.S. Case No. 323 of 2014 pending in the court of learned Chief Judicial Magistrate, Siwan.

With the aforesaid observation, this application is disposed of.
