The petitioner being the brother of the husband of the informant is apprehending his arrest in a case registered for the offences punishable under Section 498A, 408, 420, 307, 354, 109 and 376/511 of the Indian Penal Code.

The accusation is of torture and making assault. It is alleged against the petitioner that the petitioner made an attempt to ravish the informant.

It is submitted by learned counsel for the petitioner that the complaint petition suggests that the petitioner made attempt to outrage the modesty of the informant and no date of occurrence has been mentioned and accusation has been levelled to make the accusation serious.

No.40044 of 2015 (2) dt.27-08-2015 2/2 Considering the thrust of accusation against the husband of the informant, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Biraul at Benipur, Darbhanga in connection with Biraul P.S. Case No. 397 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
