The petitioner has filed this Civil Revision Petition against the judgment dated 25.11.2016 and decree dated 30.11.2016 passed in Eviction Suit No. 5 of 2014. The plaintiff/opposite party filed the suit for eviction of the suit premises on the ground of personal necessity. Learned counsel for the petitioner submits that the learned Sub-Judge has not given any finding with regard to the partial eviction of the suit property.
It appears that the suit premises is a small shop and partial eviction would not serve the purpose of the landlord. Having considered the submissions and on perusal of the judgment, I do not find any illegality and irregularity to interfere into the judgment impugned.
Accordingly, this Civil Revision Petition is
Patna High Court C.R. No.28 of 2017 (5) dt.16-03-2018 2/2 dismissed.
The petitioner is directed to vacate the suit premises within four months from the date of receipt of a copy of this order, failing which, the executing court shall take proper step to get the suit premises vacated against the petitioner. (Prabhat Kumar Jha, J.) Rakhi U
