Heard the learned counsel for the petitioner and the learned APP for the State.

The present petition is by way of second attempt at the behest of the petitioner for grant of regular bail in connection with Jakkanpur PS case no. 316 of 2020, registered under Section 414 and allied sections of the Indian Penal Code and Sections 25(1-B), 26, 35 of Arms Act, inasmuch as earlier, the prayer of the petitioner for grant of bail was rejected by this Court vide order dated 22.03.2022, passed in Cr. Misc. no. 35163 of 2021.

A report was called for from the learned court of Additional District & Sessions Judge-XVII, Patna and the same has been furnished vide letter dated 20.09.2023, from which, it

Patna High Court CR. MISC. No.58536 of 2023(3) dt.24-11-2023 2/2 appears that out of 10 chargesheet witnesses, none has been examined and moreover, the petitioner is stated to be in custody since 04.07.2020.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the parties and taking into account the period of custody of the petitioner and slow progress of the trial, I deem it fit and appropriate to admit the petitioner to the privilege of bail. 5.

Accordingly, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 20,000/- (Rs. Twenty thousand) with two sureties of the like amount each to the satisfaction of learned court of A.D.J.- XVII, Patna in connection with Jakkanpur PS case no. 316 of 2020. It is further directed that the petitioner shall appear before the learned trial court on each and every date so fixed by the trial and in default of two consecutive appearances, the present privilege of regular bail shall stand cancelled automatically.
