The petitioner apprehends his arrest in connection with Barun P.S. Case No. 262 of 2022 registered under Section 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case merely on suspicion. He further submits that as per allegation the petitioner along with others had stolen the Truck bearing registration number BR24-GB-2342 loaded with sand, which was earlier seized and parked under the care of informant (police official). The said Truck has been recovered by police on 28.07.2022 which was being driven by one Rahul Kumar @ Guddu Kumar. He also submits that the petitioner is not the

Patna High Court CR. MISC. No.53567 of 2022(6) dt.29-03-2023 2/2 owner of the seized truck loaded with sand. The owner of the seized truck is one Chandan Kumar (son of Jagnarayan Singh), who is accused no.1 in the F.I.R. The petitioner has got no criminal antecedent.

Having considered the facts and circumstances of the case as well as the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 262 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
