This application for grant of regular bail arises out of Ladaniya P.S. Case No.105 of 2024 registered for the offence punishable under Sections 14 and 14-B of the Foreigners Act, 1946.

Though the petitioner is Bangladeshi national and had valid VISA for entering Nepal but was caught within the territories of India. He had given explanation that he had entered in country by mistake while cycling and he had a business in Nepal.

The petitioner is in custody since 17.04.2024.

Learned counsel for the petitioner submits that the charge-sheet has been submitted but the trial has not begun.

Since the petitioner is Bangladeshi national and the minimum punishment for the offence(s) committed by him is two years, it is desirable that the trial of the petitioner should be concluded at the earliest. Hence, the trial court is directed to hold the trial of the petitioner on day-to-day basis and conclude the same at the earliest.

With the aforesaid observations and directions, this bail application is dismissed. 8.
